RHA tightens up ‘phoenix’ company membership

The Road Haulage Association Board of Directors has agreed, with immediate effect, that any company applying for membership of the Association following liquidation, will have to provide evidence of good repute before their application can be considered. This would include explaining the insolvency, including previous arrangements with creditors such the HMRC and the disposal of any assets or transfer of liabilities prior to an insolvency practitioner being appointed.

“This move by the RHA Board is excellent news for the industry as a whole and the Association in particular”, said RHA Chief Executive Geoff Dunning.

“This new rule of membership will be a welcome addition to existing members and will provide incentive for others to become a member of the only UK trade body dedicated to the needs of professional road hauliers.”

There has been a widespread increase in haulage company closures and the Road Haulage Association has every sympathy with those have been forced out of business through no fault of their own.

However, of even greater concern is the rise in instances of companies going bankrupt one day yet restarting, sometimes as soon as the following day, with a similar company name and some or all of the directors re-instated.

The RHA also welcomes the unanimous reaction of the Traffic Commissioners who, while agreeing that these are difficult economic times and a haulier may indeed cease trading for legitimate reasons, a director’s past record will always be scrutinised before a licence is granted.
