NUT and others will be outside the RCJ for the judicial review of AQA, Edexcel and Ofqual

The judicial review of the decisions of exam boards AQA and Edexcel and the exam regulator Ofqual that led to a shift in the grade boundaries used for this summer’s GCSE English exams begins on Tuesday 11 December 2012.

Head teachers, councils and members of the leading teaching unions, including the NUT will be outside the Royal Courts of Justice on Tuesday for the start of the judicial review.

A total of 167 pupils, 150 schools and 42 councils from the length and breadth of England and six professional bodies are taking the joint action. An estimated 10,000 students who took their English GCSE exam in June 2012 consequently missed out on a C grade as a result of the decisions. These students had achieved exactly the same standard as their classmates who were awarded a C grade just a few months earlier.

Christine Blower, General Secretary of the National Union of Teachers, the largest teachers’ union, said:

“It is a great shame that we find ourselves in this position. The lead from the Welsh Government should have been followed and the re-grading of those pupils affected should have been ordered.  Michael Gove missed the opportunity to correct this unfairness to students in England.  I sincerely hope the High Court takes a different view and rectifies this injustice.”
